Subcontract No. 620-027 (the “ Subcontract ”); SWJV Response to Spearhead’s Notice of Claim .

Ms. Hidalgo:

Skanska/Walsh Joint Venture (“ SWJV ”) is in receipt of the above-referenced letter from Spearhead Construction LLC (“Spearhead”) dated August 8, 2019 claiming additional compensation for a revised commencement date. Spearhead’s claim for additional compensation is based on a shift in Project Work start date for Installing Clips, Angles, and Attachments to Structural Steel from Contract Target Date of April 2019 to a Scheduled date of August 14, 2019. There is no basis of claim in reference to Exhibit E Section 10.5 for additional compensation as the duration of Spearhead’s Project Work has not been extended nor has the Project Work been accelerated. Furthermore, the Payroll Costs Spearhead claims to have incurred are not supported, without merit, and will not be considered. Superintendent, Project Management Project Engineer, and Employee Training are overhead costs typical to preconstruction work.

SWJV reserves all of its rights and remedies under the Subcontract.
