Preface
Spearhead Construction, LLC (“Spearhead”): Spearhead, a minority, woman, and veteran owned business, successfully completed the agreed scope of work for interior carpentry and finishes at the Pedestrian Bridge B (PBB) of the LaGuardia Airport Central Terminal Building Replacement Project. 1 Request for Equitable Adjustment: Spearhead requests an equitable adjustment (REA) to its contract in the amount of $2,265,784. Issues beyond Spearhead’s control negatively impacted productivity, driving costs substantially higher than the original contract price. Spearhead Scope: Spearhead’s work took place on Level 4 at the Pedestrian Bridge (PBB). Spearhead’s interior carpentry scope of work included installation of walls, ceilings and soffits. Spearhead also enclosed structural steel trusses with sculpted Glass Fiber Reinforced Gypsum and Cement (GFRG/C) to conceal the steel members. Scope was added to Spearhead’s contract to include walls and ceilings at transition areas on Levels 1 through 3, and the escalator from Level 4 to Level 3. Primary Issues While Spearhead anticipated its work to be challenging, it did not expect to be buried by three (3) major issues: Each of these issues created cascading delays, productivity losses, or increased labor hours, which escalated job costs. Throughout the construction timeframe, Spearhead informed the Project Management team, daily, about these issues. 2 Delayed Start Prior to signing its contract, SWJV never shared the extent to which the project was already delayed or the extent of the known structural steel deficiencies. As a result, Spearhead planned its work in accordance with milestone dates found in Exhibit D of its Subcontract, 3 which provided an eight-month duration to complete its work. Spearhead’s start was delayed by four and a half months . Despite providing timely Notice of Delay, 4 SWJV refused to extend the deadline for completion of Spearhead’s work. 1 Subcontract Number 1213126J-000.620027 2 CH 2: Chronological Account, Field Notes & Emails; CH 3: Notices, Notices Email 3 Appendices, Contract Documents, PBB Exhibit D Milestone Dates 4 CH 3: Notices, Notices – Letter, Delayed Start, 8 Aug 19 Letter – Notice of Claim: Revised Start Date What Spearhead “bid” and what Spearhead “found” upon arrival were significantly different conditions. 1. Delayed start, 2. Structural steel deficiencies, and 3. Lack of Project Schedule

Additionally, SWJV added a Change Order to Spearhead’s Base Contract to be completed concurrently and increased Spearhead’s construction duration from eight months to nine months. The delayed start meant Spearhead’s work was compressed from 9 months to 4.5 months.
Without a change to its end date, Spearhead faced completing its work in half the time.
SWJV threatened Liquidated Damages and directed Spearhead to add more manpower and resources to accelerate its work under this compressed schedule, causing Spearhead to incur extraordinary additional expenses beyond what was requested in its bidding documents and/or what is reasonably expected in relation to its Subcontract. Spearhead increased its manpower by 140%, added a second shift, and worked both shifts every day, including weekends, holidays, and overtime, or extended hours. Spearhead attributes 2,550 hours of lost productivity due to inefficiencies caused by overtime. Structural Steel Deficiencies A lack of quality control and improper installation of steel severely impacted Spearhead’s productivity. 5 Spearhead encountered unexpected field conditions that resulted in a lack of clarity, created extra work, additional engineering, and required unanticipated, on-site field modifications to every framing member and pre-formed piece of GFRG/C installed at every truss. Prior to starting its work, Spearhead participated in coordination meetings with HOK representatives, Plasterform, the GFRG/C manufacturer, and SWJV. Prior to beginning its work, Spearhead learned that SWJV was aware of structural steel deficiencies but had not shared this information with Spearhead. In one call in particular, the HOK representative pointed out that bolts had been installed backwards at the gusset plates and knew the bolts would interfere with the installation of the GFRG capitals, which they did. When Spearhead requested a Change Order to allow Plasterform to recast the pieces, SWJV refused to pay for the change 6 and forced Spearhead to solve the issue in the field, which we did, at great expense. The continuous rework and work-around solutions were necessary at each truss and accounted for dramatic losses of production. Additionally, Spearhead could not deploy multiple crews in different locations because the work had to be performed in sequence in order to align each tapered leg over the 450-foot span. 7 5 CH 1: Overview, Issues, Steel, PBB Deficiency Log – Concrete Slab Deficiencies: Bridge is flat but not level. The Pedestrian Bridge Deficiency Log points to deficiencies in the concrete slab pour. Spearhead had to scribe the GFRC bases at each truss that pitched South to North and West to East. At the center of the bridge, the deck actually swells upwards instead of pitching downward toward the North. Complicating matters further, each side of the bridge pitches in different, or unique, increments. The slope is inconsistent, falling sharply in some areas and smoothing out in other areas. Leveling the bases to the deck while also taking into account the out of plumb trusses at every single base took time to establish a level line and scribe the bottoms. Spearhead conducted a survey in 5’- 0” increments and found its results matched the inspector performing the official survey. 6 CH 3: Notices, EM-6 12 Jun 19 Extra Cost – Bolts installed backwards – Mock thinks it’s fine to spitball calculations on a napkin and decide a “fair value” for Spearhead to overcome this known structural deficiency. 7 CH 1: Overview, Issues, Steel, PBB Deficiency Log– Non-Conformance – As-Built geometry not in compliance with designed profile. Out of plumb trusses and improperly installed bolts led to lost time at every truss. Ripping studs at an angle to “square up” steel by up 2” at the tops or bottoms is NOT typical.
Spearhead Construction, LLC * PO Box 575 * Fort Montgomery, NY 10922
The movement / out of alignment of the steel also impacted the roof and deck elevations. Spearhead had to routinely “come back” or change ceiling elevations as a result of differing field conditions while the GFRC bases had to be cut along the uneven concrete deck that was “flat, but not level.” Lack of Schedule Despite repeated requests 8 , SWJV refused to provide a current, official project schedule to Spearhead. Without even a 2-week “Look Ahead,” Spearhead was left to make sense of images stitched together during the mandatory Pull Sessions hosted by SWJV back in July 2019. The lack of Schedule created an atmosphere of The Wild West with poor coordination leading to issues including, but not limited to:
• Congestion • Trade Stacking • Out of sequence work • Out of sequence fabrication of GFRG/C • Hoist delays • Stop-and-go work • Re-work • Comebacks • Short notice stoppages • Short notice delivery moratoriums • Poor access to work areas • Other delays such as wait time for 3 separate inspectors • “Hey you” extra work • Damage to installed work
In Summary Each of these issues created cascading delays, productivity losses and escalated costs. As the pace became frenetic, Spearhead proactively hosted weekly collaboration meetings to help SWJV meet a “schedule” Spearhead was only saw one time, in July 2019, on Post-It notes. Throughout the construction timeframe, Spearhead informed SWJV, daily, about these issues with minimal resolution. Detailed project notes and communications are provided to validate these claims. Spearhead Construction respectfully requests an immediate and equitable resolution in the amount of $2,265,784 before January 30, 2021. The delayed close out of this project continues to have a meaningful, negative financial impact on Spearhead Construction, and its owner.
Thank you for your attention.

Scope of Work - BOH
SWJV identified a “scope gap” for the area between the Pedestrian Bridge and Concourse B, also known as, “Back of House” (BOH). SWJV selected Spearhead to perform this work and BOH Change Order (CO) #2 reflects the additional scope.
The BOH CO #2 consisted of installation and finish of gypsum walls and ceilings in areas throughout Levels 1 through 4, including:
Stairwell Lobbies
Escalator
Elevators
Control rooms
Electric closets
Additional, areas included:
A roof access corridor , stretching across the escalator, connects the BOH areas on Level 4 to the exterior of the building. The line of demarcation between Concourse B and BOH scope of work occurs at the corridor ceiling and expansion joints between both areas.
A suspended ceiling below the access corridor conceals the walkway with upturned, flared returns.
A feature wall on Level 3 encapsulates the northern face of the elevator lobby. The gypsum partition transitions into a rounded, GFRG corner, continuing to the foot of the escalator.

Loss of Productivity; Lost time
Poor Scaffold Design
Spearhead provided efficient scaffold solution; PM’s inefficient scaffold resulted in lost time, 3-tiered bakers on top of scaffold, and pipe scaffold directly on escalator treads
Spiders
Takes 3.5 mins RT to reach location @ Moving Walkway
Congestion
Loss of Productivity Trade stacking; Overmanning GFRG sat in warehouse for entire month due to congestion on bridge Request to work 2nd shift to alleviate congestion (denied)
Lull, 1 ea
Delays in getting materials and equipment to work areas 3 weeks to hoist last Spearhead lift Delays waiting for repairs to lull
Overtime
Consecutive days of overtime leads to substantial lost productivity
Spearhead Delayed Start Spearhead worked outside the box to aid Compressed Schedule
Innovation BBH and Panelmax
Innovation – Spearhead hustled to get Blue Banger Hangers approved prior to roof membrane. We worked as the concrete decking cured. To remove risk of GFRG fabrication shortfall, or delay, Spearhead acquired Panelmax to fabricate truss legs on site. Spearhead took this on as a way to help SWJV with its compressed schedule.

ENTER TEXT Enter Text Enter Text Spearhead Delayed Start Major source of Increased Costs – Compressed Schedule
Enter Text Poor Access
Spearhead provided solution for fixed platform with “window washer” sides that would allow all trades to work efficiently above escalator. No damage to side walls upon removal of scaffold. PM ordered inefficient, terraced hanging scaffold, instead. Poor access created: 1. Unnecessary safety risk using 3-tiered bakers' scaffold on top of hanging platform 2. Loss of productivity caused by comeback or re-work

Spearhead Impact of Steel Spearhead Lost Productivity
Impact of Steel
Inconsistent floor slope; Concrete added to elevate FF Each base “scribed” to uneven floor (south --> north; west --> east) Pitch caused multiple comebacks / revisions Changed ceiling elevations (Example: 3x @ North elevator lobby) Created numerous ”hits” with other trades (pipes/ductwork) GFRG Soffit flares would not line up w/o substantial modification Had to fabricate gyp soffit flares - unexpected Required continuous elevation verifications with HOK and SWJV Found conditions led to field modifications and sequential installation Access lines no longer centered on trusses Clips field-modified (extended or cut back) Framing field-modified (“ripping” studs at angle / taper) GFRG/C pieces field modified (shaved back @ bolts) Required vigilance to hold correct line of tapered tips of each chamfered edge Forced sequential installation; could not deploy independent crews, working concurrently
Bridge "dropped"
Roof "dipped"
Out of plumb
Bolts backwards
Plasterform quoted additional $70k to accommodate Spearhead forced to absorb labor costs and lost time to modify in the field
Spearhead Impact of Steel Major source of Increased Costs – Continuous Field Modifications / Re-work
Steel Out of Plumb
Continuous re-work caused by out of plumb steel
Image Left: Access Lines 1. Access lines not centered on trusses 2. Variance of access line to center line of truss as large as 2” 3. Truss framing required re- work to “straighten” trusses to accept GFRG/C Image Right: Clips and Studs 1. Clips had to be extended on one side and cut on opposite side 2. Studs were “ripped” down / shaved off to taper into truss in order to provide squared surface to attach GFRG/C
