B. Labor factors shall be stated and identified in "per unit", "per each", or some other means to associate labor hour calculations with materials, and equipment listed, and shall state basis or source (if a published means standard) to validate labor factors. Contractor's approval of the published standard is required. Methods, whether published or implied practices, which purpose to cause cumulative factoring of labor value by hypothetical formulas, speculation of supposition related to productivity impact, conjectures or difficulty, or any premise which is NOT relevant to the actual conditions of Work, shall be deemed void, and shall not be considered by Contractor as a qualified credible demonstration of Subcontractor's labor hour summations. C. Labor hours shall be summarized by each trade and worker levels, and predetermined hourly rate plus percentage increment and related cost for overhead and profit. D. Subcontractor-owned rental equipment or rental equipment from a secondary source to be used in performing the change in Subcontractor Work shall be identified stating anticipated hour of use, cost per hour, and predetermined percentage increment for overhead and profit. E. Backup documentation to validate cost, including but not limited to, proposals or invoices for material, equipment, Sub-Subcontractor's costs, rentals, or any other cost will be required, and shall be submitted in the same detailed format as described. 3. Change Notice Per Exhibit E-Article 10 of Contractor's Agreement, Contractor may order changes in Subcontract work by issuing a Change Notice to Subcontractor, including any additional conditions or provisions applicable. A. A Change Notice that is performed under a "LUMP SUM" or "COST NOT TO EXCEED" basis must be supported by Subcontractor's detailed estimate proposal (in the same format described in Subsection 8.2 above) for submittal to and approval by Contractor. B. A Change Notice that includes changes of Work covered by predetermined "UNIT RATES" shall be noted in the Change Notice. C. A Change Notice that includes changes of Work performed under a “TIME AND MATERIAL” basis shall be noted in the Change Notice stating the ROM (Rough-Order-of –Magnitude) Estimate value. 1. All materials or equipment covered in Change Notice work must be identified stating description, sizes, and quantities and accompanied by delivery tickets submitted for review, approval, and signature by Contractor's Project Manager in charge at the time of delivery. 2. Labor for the Change Notice work shall be identified by Change Notice number(s), daily time slip listing worker's name, worker level (i.e., foreman, journeyman, apprentice, laborer, etc.), Change Notice hours worked, and shall include only such foreman as are working directly on Change Notice work (supervisory personnel will not be listed). Time slips shall be submitted DAILY to Contractor's Project Manager or Project Superintendent for review, approval, and signature. 3. At such time upon completion of the Time and Material Change Notice work, Subcontractor shall submit to Contractor a summation of costs of the Change Notice work in duplicate stating material and equipment, quantities, unit rates and extended costs, labor hours, labor rates, plus predetermined percentage increments for overhead and profit, substantiated by backup documentation signed by Contractor's field superintendent. All material or equipment costs must be submitted with supplier's actual invoice to confirm costs stated by Subcontractor. Any backup not signed by Contractor shall be deleted from Subcontractor's request for cost adjustment.
