Disturbing Behavior Mr. Corallo, it is disturbing to learn that SWJV knowingly accepted an alleged “severely low” value from an MWBE/SDVOB company during the bidding process as you admit in your Response. It clearly begs the question of why if Spearhead severely underbid this work, did SWJV accept the nonviable bid at the time of award? This type of behavior gives the appearance of knowingly setting up a young company, like Spearhead, to underperform. This behavior is arguably another form of “bait and switch” and reflects poorly on the organization you represent and contradicts the purpose of MWBE/SDVOB programs designed to develop Small Businesses and bolster the supply chain. Inaccurate Mr. Corallo, Spearhead provided the final quantities of remaining work to you two months ago. The value of the work shown in your letter is based on outdated information, either deliberately or incompetently, and does not reflect work Spearhead continued to perform. Additionally, all of the “Schedule of Values” items you listed were previously submitted and approved as 100% complete. Mismanagement Mr. Corallo, the disturbing behavior, the inaccurate final quantities and inclusion of Schedule of Values items that have already been approved, all point to your lack of understanding of the work for which you were charged to manage. By reason of the foregoing, and as a result of removing Spearhead’s work for its own convenience, Spearhead will not provide any credit for work it was ready, willing and able to perform before being wrongfully prevented from doing do so by SWJV. Spearhead reserves any and all rights under its Subcontract.
