As a result, Spearhead contacted the SWJV PM and declined the work. The PM pleaded with Spearhead to have a conversation and asked to meet on site. During the meeting the PM asked what it would take to get Spearhead to tak e the job after the PM had already, “announced to all the other contractors that Spearhead won the job!” He went on to share how he really wanted Spearhead to do the work and that Walsh had won the JFK project and he could put in a “good word” for Spearhe ad. Spearhead had been told to price its proposal without costs for scaffold above the escalator. One of the conditions for Spearhead to take on the added scope was that the change to the contract include specific language stating the escalator was no cost to Spearhead.
