• Delayed start The 4.5-month delayed start, without adjustment for completion date, resulted in compressed work and increased operational complexity. As a result of the late start, Spearhead's was required to complete our work in half duration provided in our contract. 3 • No schedule Poor coordination of other critical work streams compounded the inefficiency of compressed work durations. • Out of sequence work Re-work, multiple comebacks, congestion and inefficient access to work areas, often requiring use of aerial boom lifts 80 feet off the ground versus working from the floor inside the structure, caused substantial inefficiencies. • Lack of quality control Improper installation of steel (truss legs out of plumb with bolts installed backwards at gusset plates) required continual field-modifications and incessant work-around solutions throughout entire project. • Narrow footprint Narrow width of bridge coupled with a compressed schedule and moving walkway laydown area, led to significant trade stacking and congestion making access to work areas grossly inefficient. Each of these issues created cascading delays, productivity inefficiencies and losses, which escalated Spearhead's job costs. Throughout the construction timeframe, Spearhead informed SWJV Project Management Team about these issues with slow, late, minimal or no resolution. Detailed project notes, photos and communications documents validate these claims. I spoke with Thomas Nilsson, your predecessor, on three separate occasions but had no success in securing a meeting. On September 4, 2020, I contacted the PANYNJ Compliance Office for assistance in coordinating a meeting. In the meantime, Spearhead desperately needs an injection of cash if it is to survive to the end of the year. The $3M in damages represents a significant portion of Spearhead's annual revenues. Over the last eight months, Spearhead has managed to finance this amount to keep Spearhead in business. As of this writing, Spearhead has exhausted all resources and is weeks away from shutting down. Putting Spearhead in this position is unconscionable, particularly in light of the refusal by your predecessor to even take a
