Sean Bronson Executive Project Manager XBR Inc. 35-12 19 th Avenue, Suite 2E Astoria, NY 12210 RE: RESUBMISSION - SPEARHEAD COVID-19 INCURRED COSTS CLAIM / COR 11 R2 Project: BCM – PV262 – AUD Brooklyn Children’s Museum Auditorium Mr. Bronson: Spearhead Construction, LLC (“Spearhead”) provides the following, additional information to clarify the added expense to comply with New York State Department of Health, New York City Department of Design and Construction, and New York City Department of Buildings (“Agencies”) mandates and site-specific requirements, located in the references below, for performing construction during the COVID-19 pandemic at the Brooklyn Children’s Museum Auditorium. References: 1. NY Forward Business Re-Opening Safety Plan Template 2. New York State Department of Health Interim Guidance for Construction Activities During the Covid-19 Public Health Emergency, 2020. 3. Clarification: Different Site Conditions – New, Added Tasks Compliance with the Agencies’ and site specific COVID-19 procedures caused additional work steps, which were not anticipated at time of bid nor included as part of the Contract documents. These different site conditions caused added work steps resulting in unplanned, additional labor hours beyond the contracted scope of work. As a matter of public safety, the Agencies, Owner, and General Contractor (GC) required Spearhead to perform additional tasks, which resulted in

incurred costs of additional labor hours. These new, added tasks for each worker, are summarized in the following Table 1.

Different Site Conditions - New, Added Tasks Prior to Commencement of Work Due to differing site conditions caused by the unprecedented COVID-19 event, additional tasks were required at the start of each workday. An average of six Spearhead workers stood in line and waited to have their temperatures measured and recorded. Workers had to verbally confirm no COVID-19 symptoms to the Foreman. Additionally, to adhere to the Agencies’ guidelines, workers were also required to complete an electronic COVID-19 self-reporting form on Monday mornings. Prior to work assignments: 1. daily health screening questions and temperature readings, (+ 6 mins / workday) 2. weekly confirmation that workers had not returned from restricted COVID areas, 3. daily protocol information entered and submitted to office. (+3 mins/workday) • Once all workers were deemed “fit for duty,” the Foreman assigned crews and tasks, while taking into consideration social distancing throughout each area of the jobsite. Screening, administrative tasks, crew reassignment, and daily temperature readings amounted to nine additional minutes per worker, per workday. For reference, morning assignments of Spearhead average crew size of six workers in a pre-pandemic environment typically accounted for 10—15 minutes. During Spearhead’s work at Brooklyn Children’s Museum, morning assignments increased from 10—15 minutes to 19—24 minutes because of these added tasks.

• Additionally, Spearhead’s Foreman had to verify the information for accuracy and ensure workers completed the Spearhead Covid-19 Weekly Screening information then submit electronic copies to office staff for collection, review, tracking, and filing as part of the change in site conditions on a weekly basis. Each of these new, added tasks required additional time that employees would have otherwise spent performing job tasks during pre-pandemic conditions. Clarification: Quantifying Additional Labor Hours Resulting from New, Added Tasks Workers were also impacted throughout their workday because of different site conditions stemming from compliance with the Agencies’ guidelines. Spearhead incurred additional labor expenses beyond its contracted scope of work and quantified the added time of six minutes per hour, or 48 minutes per 8 hour workday, by worker. 1 Throughout workday: 1. social distancing - change in means and methods, (+2 mins / workday) 2. daily fatigue of wearing of additional PPE, (+6 mins / work hour or + 48 mins / 8 hour workday) 3. additional hand washing, sanitization, and hygiene measures, (+ 6 mins / workday) 4. daily disinfection of tools and materials, (+10 mins / workday). Different Site Conditions - New, Added Tasks Throughout Workday The additional 48 minutes per worker, per 8 hour workday, is in line with the Nationwide study, Pandemics and Productivity: Quantifying the Impact report, which is included in this eBook for reference. Please note that the study focused on “fit-for-duty” mandates that were identical to the requirements of Spearhead workers, regardless of specialty trade. The comparison of the findings in the study to Spearhead’s actual hours expended is valid and offered as additional justification of its claim. The following factors contributed to the additional six minutes per hour: social distancing, increased Personal Protection Equipment (PPE), fatigue and dehydration, material handling, increased water consumption, extra handwashing, and additional rest times. Social Distancing caused Spearhead to change its means and methods. • Adherence to COVID-19 social distancing procedures required Spearhead to implement newmeans and methods for crew assignments. Prior to COVID-19, Spearhead could have multiple crews working simultaneously in the same area. However, in attempting to limit potential COVID-19 exposures, crews had to work independently, in different locations from one another and from other trades. Whenever possible, crews were maintained from day-to-day without mixing personnel.

• In pre-pandemic conditions, Spearhead typically completed taping and finishing with one crew working simultaneously in a space as a team and in an assembly line fashion. Crew members focused on specific tasks and worked efficiently, in tandem with one another. However, due to social distancing requirements, Spearhead crews had to switch between various tasks to limit the number of personnel in each area at the same time, which added time to complete the work. Each of these new, added tasks required additional time that employees would have otherwise spent performing job tasks during pre-pandemic conditions. New PPE requirements caused an increase in physical exertion to complete tasks. The burden of wearing a mask in a construction environment is different than wearing a mask in an office setting. Neither scenario is ideal, but construction workers expend far more energy throughout the day. • Fatigue: Spearhead workers handled materials by accepting and unloading deliveries, carrying materials to specific work locations and installing materials. At the Brooklyn Children’s Museum project, workers had to unload materials from delivery trucks parked more than 400 feet from building, move materials across two floor levels and hand individual pieces up to a scaffold platform. Handling 200- to 300-pound Glass Fiber Reinforced Gypsum (GFRG) panels, 64-pound buckets of finishing compound and other construction materials required additional exertion and time to complete work tasks due to breathing through a facemask, which led to labored breathing, an increased need for hydration, and resulted in greater fatigue. • Obscured Vision/Fogged Eyewear: After moving materials to their final place of rest, workers had to hoist these heavy GFRG panels up to 8 feet above the platform to install and finish the GFRG panels at the ceiling. Wearing a facemask also caused an increase in physical exertion which led to labored breathing. The warm, moist air moving through the facemask also led to condensation of protective eyewear. Workers had to stop, periodically, and wipe the glasses clear, which added more time and frustration to complete their tasks. • Dehydration: To illustrate the effects of COVID-19 safety procedures on the fatigue and dehydration levels of workers, on average in pre-pandemic conditions, workers consumed two bottles of water per day provided by Spearhead. However, during COVID- 19, workers at the Brooklyn Children’s Museum project consumed an average of four bottles of water per day to replenish electrolytes caused by physical exertion while breathing through a mask all day.

• Personal Hygiene: Mask wearing requirements necessitated additional water breaks as a direct result of fatigue, dehydration, and a need to urinate more frequently. Workers

required additional time to clean their hands with sanitizer prior to retrieving water from a central location, consuming the water, and defogging safety glasses. After using the latrine, workers had to clean hands with sanitizer, again. Each of these new, added tasks required additional time that employees would have otherwise spent performing job tasks during pre-pandemic conditions. Mental Fatigue Added Time to daily tasks The COVID pandemic was, and continues to be, an unprecedented social, health, and economic disaster not only affecting the world at large, families, and individuals, but also construction workers, specifically. No one could have predicted the impact the pandemic would have on worker shortages, supply chain disruptions, or the stability of workforce psyche plagued with fears of contracting the virus, potentially exposing family members, or the financial implications of work stoppages or shutdowns. The Elsevier study, Impact of Covid-19 on Field and Office Workforce in Construction Industry, indicates that across the construction industry, workers experienced increased anxiety and trauma as a result of fear of exposure to the life-threatening virus, particularly when multiple subcontractors were working on site near one another. Throughout the course of this project, test sites and test kits were in high demand with limited supply. Medical experts grappled not only with finding the most effective and reliable treatment but also for space to treat the sickest patients. Deaths skyrocketed every month. • This project site was conducive to spreading the virus by nature of working indoors, with no windows, or outside ventilation, amongst multiple tradesmen. Spearhead had an average of six workers on site each day. Other trades had a similar number of workers, all in close proximity. The jobsite lacked a handwashing station and workers had to rely on personal hand sanitizers. Without a vaccine, the only tools workers had to combat the spread of the virus was relentless vigilance in wearing a mask, personal hygiene with hand sanitizers, and daily cleaning of tools, materials, and equipment. • Meanwhile, Spearhead leadership had to closely monitor worker health, review daily questionnaires, and take steps to remove workers who had potentially been exposed to the virus or who presented with symptoms of the virus. • Workforce mental fatigue caused by the virus and additional precautions resulted in increased callouts. Locating additional labor in a timely manner proved difficult for Union leaders. Workers who remained on site experienced increased stress and anxiety for fear of exposure or infection by those who did not always wear a mask, required testing, or tested positive. Mental fatigue led to increased exhaustion and required additional time that workers would have otherwise spent performing job tasks during pre-pandemic conditions.

End of Day Clean up Added Time to Daily Tasks Finally, workers were impacted at the end of their workday, as well. Prior to completing their workday, workers were required to individually sanitize tools and materials that they were in contact with throughout the day, above and beyond just returning tools to lockboxes as in pre- pandemic conditions. Due to the fluid nature of our national understanding of the pandemic, workers left the site more exhausted than normal and unsure what changes might be required of them in the following days. Conclusion Added tasks, time to complete the new tasks, and incurred labor costs of properly and safely maintaining caution in a virus-ridden environment contributed to additional project hours and out-of-pocket costs to Spearhead. The extra labor hours required to complete the work and tasks were a direct result of the COVID-19 pandemic and were in addition to contract requirements, known existing conditions at time of bid, and what could have been reasonably expected of any subcontractor at the time of the estimate and signing of the Brooklyn Children’s Museum contract. Lastly, Spearhead includes in this package an updated hours breakdown through the end of the project. As such, the revised COR 11 R2 totals $100,904 of additional costs to comply with Agencies’ Covid-19 protocols.

Spearhead handled and installed over 25,000 pounds of construction materials and equipment multiple times, throughout the Auditorium, while wearing a face mask, steaming up protective eyewear, fighting fatigue and stress. Denying this request for reimbursement is unrealistic as Spearhead and its workforce literally shouldered the weight of this New York City project to finance the full expense of these added tasks. The lack of reimbursement for these out-of-scope requirements, different site conditions, and non-contracted work tasks, carried for over a year, continues to financially harm Spearhead Construction.
