SWJV received the above referenced letter from Spearhead dated October 30, 2019. Spearhead’s assertions and contentions regarding Schedule and Verbal Direction are unsubstantiated and lack merit. SWJV provided a schedule to Spearhead. Furthermore, SWJV reaffirms the position set forth in our letter to you of October 30, 2019 and that Spearhead is obligated to meet contract durations established in Contract Exhibit D. SWJV reserves all rights and remedies under the Subcontract.
