RE: LaGuardia Airport Central Terminal Building Replacement Project (the “ Project ”); Subcontract No. 620-027 (the “ Subcontract ”); SWJV Response to Spearhead’s October 24 Follow Up to Written Directive.

Skanska/Walsh Joint Venture (“ SWJV ”) is in receipt of the Spearhead Construction LLC (“Spearhead”) correspondence dated October 24, 2019 regarding written direction for RFI-144 as well as a schedule. Spearhead owes a credit for the 0-hour rated wall that was removed after Rider D comments. Refer to attached Contract Exhibit B drawing A47-60-00-00-00 described as “ CONCOURSE B - ENLARGED SECTIONS - RATED SOFFIT @ PEDESTRIAN BRIDGE” dated April 13, 2018. This drawing shows a 0-hour rated stud wall (0F6B), which is called out on A21-AJ-4L-BF-6C at the escalator and is part of Spearhead’s base contract. Rider D changed this stud wall to a concrete wall for fire rating and subsequently RFI PBB-144 changed the wall back to a stud wall with a 3-hour rating. SWJV was never provided a credit between Rider C and Rider D. Therefore, pricing for the wall should show credit for the 0-hour rated wall removed between Rider C and Rider D and add for new 3-layer wall. Furthermore, a schedule for coordination was sent to Spearhead on June 26, 2019. Per Exhibit E Article 3.3, Spearhead shall furnish SWJV with a Work Plan, which shall include the anticipated sequence of the Work and durations in terms of days and man-hours for the work activities necessary to complete the Work in the time required to support the Project Schedule. Spearhead’s other contentions regarding SWJV verbal direction are unsubstantiated. SWJV is entitled under Exhibit E Section 9.2, “to decide the time, order and priority for performance of the various portions of Subcontractor's Work to the extent necessary, in Contractor's judgment, to assure Subcontractor’s compliance with the Schedule,” and further that “Subcontractor shall anticipate and provide for such activities.” The verbal direction referenced in the Spearhead letter was actually a notification of work areas available for Spearhead so that Spearhead could continue working to support the Project schedule and coordinate its work with other contractors. Finally, while there was ongoing coordination with other trades in the area, Spearhead’s access to an aerial boom does not permit Spearhead any cost or schedule relief, as Spearhead is solely responsible for supply all equipment required to perform and complete the work per Exhibit E of the Subcontract.
