Skanska/Walsh Joint Venture (“ SWJV ”) is in receipt of the above-referenced letter from Spearhead Construction LLC (“Spearhead”) dated October 23, 2019 regarding cost associated with additional work for a 3 hour wall in lieu of concrete wall at level 3 east escalator wall per RFI PBB-144 Response. SWJV acknowledges additional work for the change in scope and directed Spearhead to perform work in accordance with the RFI response. SWJV does not agree with the proposed lump sum price for this additional scope of work and requests Spearhead to provide detailed estimate per Exhibit C Part 5 Section 3 – Change Notice (on p. 8 of Exhibit C). Time is of the essence to complete work on East and South Escalator Walls. Per contract Exhibit E 10.2 – Change Requests, section (a) Contractor Initiated Change, “Subcontractor shall have no right to suspend or delay the performance of its obligations under the subcontract while Contractor is reviewing Subcontractor’s adjustment request.” SWJV reserves all rights and remedies under the Subcontract.
